Overview
WisePH respects intellectual property rights. We comply with the Digital Millennium Copyright Act (DMCA) and respond to valid copyright infringement notices. If you are a copyright owner and believe someone used your work without permission, this page explains what to do.
In addition, this policy covers how we handle counter-notifications from users who believe we removed their content in error.
How to file a DMCA takedown notice
To submit a valid DMCA takedown request, your notice must include all of the following:
- Your full legal name, address, phone number, and email address
- A description of the copyrighted work you believe has been infringed
- The exact URL on WisePH where the infringing content appears
- A statement that you have a good-faith belief the copyright owner, its agent, and the law do not permit this use
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf
- Your physical or electronic signature
Incomplete notices will not be processed. Specifically, we will disregard notices missing the infringing URL or a good-faith statement.
Where to send your notice
Send your DMCA takedown notice through the contact form on this site. In the subject line, write “DMCA Takedown Request” so we can identify and process it quickly. We aim to respond within 5 business days.
What happens after we receive your notice
Once we receive a complete and valid notice, we will:
- Review the claim against the content on the site
- Remove or disable access to the infringing content if the claim is valid
- Notify the user who posted the content, if applicable
- Keep a record of the notice as required by law
We act in good faith. However, we will not act on notices that are incomplete, fraudulent, or clearly abusive.
Counter-notification process
If we removed your content following a DMCA notice and you believe we took it down in error, you can file a counter-notification. To be valid, your counter-notice must include:
- Your full legal name, address, phone number, and email address
- Identification of the content we removed and its previous location on the site
- A statement under penalty of perjury that you have a good-faith belief we removed the content by mistake
- A statement that you consent to the jurisdiction of the appropriate court in your location
- Your physical or electronic signature
After we receive a valid counter-notice, we will forward it to the original claimant. If the claimant does not file a court action within 10 to 14 business days, we may restore the removed content.
Repeat infringer policy
WisePH has a zero-tolerance policy for repeat copyright infringers. We will terminate the accounts of users who repeatedly post infringing content. Furthermore, we will cooperate with copyright owners and law enforcement when required.
Misuse of the DMCA process
Filing a false DMCA notice or counter-notice is a serious legal matter. Under US law, a person who knowingly misrepresents that content is infringing may be liable for damages. Therefore, only submit a notice if you genuinely believe your copyright has been violated.
